Terms of Reference for Provision of Occupational Safety and Health Audit and Training

1. About ChildFund

ChildFund is a non-sectarian and non-profit development organization working in more than 30 countries worldwide to improve the well-being of about 15.2 million children and families, regardless of race, creed, religion, and gender. In Kenya, ChildFund works through 12 local partners (LP’s) in 26 counties. The thematic areas that the organization focus on include Child Protection, Household Economic Strengthening, Early Childhood Development, Education, WASH (Water, Sanitation and Hygiene), Disaster Risk Reduction (DRR), Emergency Response, Health and Nutrition. The three-fold mission is to help deprived, excluded and vulnerable children improve their lives and become adults who bring positive changes to their communities: to promote societies that value, protect, and advance the worth and rights of children and to enrich supporters’ lives through their support of the organization’s cause.

2.Objective of the Consultancy

ChildFund Kenya intends to carry out Occupational Safety and Health Audit and Training by engaging a competent professional or firm to conduct the same as illustrated below.

The objective of this consultancy is to ensure that ChildFund Kenya Country Office (CO) comply to the Legislative Act of Occupation Safety and Health in working place.

The Consultant is expected to conduct an exhaustive Audit on all areas and training as mentioned below in the Scope of work. Review the current ChildFund Kenya health and safety measures in place, collect and analyze data on the status in consultation with the Human Resource Director (HRD), Admin Specialist, Safety and Security Person of Contact (SPOC) and conduct a literature review on the current best practices in OSH as far as the Audit objective is concerned.

The awarded supply shall carry out the activities listed here below and provide the deliverables specified.

1. OCCUPATIONAL SAFETY AND HEALTH AUDIT

The audit criterion will be based on;

  • Occupational Safety and Health Act, 2007 and Subsidiary legislations.
  • The Code of Practice on Occupational Safety and Health Auditing.

1.1 Objectives of the audit

The main objective of the survey is to identify and make recommendations for eradication of any potential safety and health risks associated with the infrastructure, tools and equipment, processes, procedures, and work environment at the workplace.

The Specific objectives include:

  • To assess and evaluate the effectiveness of the organization’s safety management systems.
  • To identify hazards in the workplace.
  • To verify compliance with the applicable standards.
  • Document the finding and make recommendations.

1.1 Deliverables

  • Draft copies of the prepared reports for review & input prior to preparation of final
  • Report.
  • The report shall also include a corrective action plan based on audit findings.
  • Three (3) hard copies of the final report for Acknowledgement by the Client, Safety and Health Advisor, and Directorate of Occupational Safety and Health Services (DOSHS);

2. FIRE SAFETY AUDIT

The audit criterion will be based on;

  • The Fire Risk Reduction Rules, 2007
  • The Code of Practice on Fire Safety Auditing

2.1 Objectives of the audit

The objectives of the audit include the following.

  • To meet the legal requirements of the Occupational Safety and Health Act, 2007 and the Factories and Other Places of Work (Fire Risk Reduction) Rules, 2007.
  • To identify and draw attention to fire risks and hazards and the means by which loss can be minimized.
  • To assist the management to minimize fire hazards at the workplace.

2.2 Deliverables

  • Draft copies of the prepared reports for review & input prior to preparation of final report.
  • The report shall also include a corrective action plan based on audit findings.
  • Three (3) hard copies of the final report for Acknowledgement by the Client, Safety and Health Advisor, and Directorate of Occupational Safety and Health Services (DOSHS).

3. OCCUPATIONAL STATUTORY RISK ASSESSMENT

This Report is prepared in line with:

  • Section 6 (3) and 6 (4) of the Occupational Safety and Health Act, 2007 of the laws of Kenya.

3.1 Objectives of the audit

  • To document on the health and safety risk status of the company through Hazard identification and assessment of the workplace operations.
  • To advice the occupier on matters relating to improving Occupational Health and Safety risks.
  • To submit copies of the risk assessment to the Directorate of Occupational Safety and Health Services for follow up.

3.2 Deliverables

  • Draft copies of the prepared reports for review & input prior to preparation of final report;
  • The report shall also include a corrective action plan based on audit findings.
  • Three (3) hard copies of the final report for Acknowledgement by the Client, Safety and Health Advisor, and Directorate of Occupational Safety and Health Services (DOSHS);

4. OCCUPATIONAL SAFETY AND HEALTH COMMITTEE TRAINING

The training criterion will be based on;

  • Directorate of Occupational Safety and Health (DOSHS) Training curriculum.
  • Nature of operations undertaken at your organization.

4.1 Course Objectives

  • To create awareness in OSH within your organization.
  • Reduce occupational incidents’, accidents, and cases of Occupational Diseases.
  • To share experiences and expectations in OSH in your organization.
  • Comply with the Occupational Safety and Health Act, 2007 and its subsidiary legislations.

4.2 Training Mode

  • In house training.

4.3 Training Duration

  • 30 hours/Four (4) days or as may be agreed.

4.4 Deliverables

  • Draft copies of the prepared training reports for review & input prior to preparation of final Report.
  • Three (3) hard copies of the final report for Acknowledgement by the Client

5. FIRE SAFETY TRAINING

5.1 Course Objectives

  • To be aware of key fire safety requirements under the Factories and Other Places of Work (Fire Risk Reduction) Rules, 2007.
  • To be able to recognize habitual human behavior in a fire situation.
  • To be able to recognize the importance of effective fire emergency evacuation.
  • To be able to state the basic principles of fire risk assessment.
  • To be aware of how to prevent fire or limit its consequences.
  • To be able to identify and operate a rage of portable fire extinguishers.

5.2 Course duration:

  • 14 hours spread over 2 days. (As will be agreed)

5.3 Training Mode:

  • In house/site training

5.4 Deliverables

  • Draft copies of the prepared training reports for review & input prior to preparation of final Report.
  • Three (3) hard copies of the final report for Acknowledgement by the Client

NOTE:

The following audits are conducted on an annual basis as per the requirements on the law;

Occupational Safety and Health Audit.

  • Fire Safety Audit.
  • Occupational Safety and Health Risk Assessment Audit.

A. The following shall apply to the trainings.

i. Safety and Health Committee training will target the safety and health committee at the workplace.

ii. Refresher Fire Safety training should be conducted after every two years.

4. Consultants’ Qualifications

The consultant must have the following competencies:

  • The consultant awarded the contract must be accredited and approved Safety Advisor/Auditor and registered by DOSH to audit, review, analyze and advise Organization on effective implementation of safety at the working place accordance to OSHA.
  • Be a degree holder with a minimum qualification of Diploma in occupational safety and health from a recognized institution and should have at least five years proven practical experience in OSH Audits.
  • Must have led at least four similar Audit and training in the past three years
  • Should have demonstrated understanding, knowledge, skills on Occupational Safety and Health field
  • Having vast experience in training for the adult as well as well-employed participatory training methods.
  • Familiar with the relevant policies and laws on the subject
  • Excellent analytical and report writing skills
  • Excellent written and spoken English

5. Payment mode

Payment will be done upon submission and acceptance of the final audit and training report by ChildFund Kenya.

NB:

  • The Consultant’s compensation shall be paid within 30 days from receipt of a proper invoice unless otherwise specified.
  • Payment will be made by Bank transfer unless otherwise specified.

The payment shall be subjected to 5% withholding tax as required by the Law at the time of payment.

Interested candidates who meet the above qualifications are invited to bid for one or more of the following lots.

  1. Annual Audit (Occupational Safety and Health Audit, Fire Safety Audit and Occupational Statutory Risk Assessment)
  2. Occupational Safety Health Committee Members training
  3. Fire Safety Training

The application should include technical and financial proposal. The technical proposal should clearly indicate the qualification and previous similar assignments undertaken.
