Tender Name: Provision of a New Tractor
Introduction
1. KENYA GOOD NEIGHBORS (hereafter, “KGN”) was founded in December 1995. It was the first field office in Africa that Good Neighbors International has built for international relief and development programs including social enterprise Mwamba Oibor Dairy Ltd., vocational training at Jirani Centre, health clinic, community dam construction, and school construction. We implement community-based development projects in six communities: Bissil, Dandora, Korogocho, Meguarra, Mukuru, and Ogembo.
2. Duly completed documents should be returned by email: gn.kenya.procurement@gmail.com on/before 18th July 2021, 11:59 East African Time, addressed to the Tractor Procurement Committee. Indicate the tender reference [KGN/003/2021] in the title of your email. All documents should be in non-editable format such as PDF.
3. Mandatory submission includes the below listed. For more DETAILS on required documents, please read through the “III. Evaluation Criteria.”
a) Form of tender;
b) Company profile;
c) CR12;
d) Certificate of registration;
e) PIN Certificate and Tax Compliance Certificate;
f) Quotation;
g) Tractor Information (layout, photo, catalogue, etc);
h) Previous Sales Detail (for the last two years);
i) Details of bank account;
j) Audited accounts (of last two years); and
k) Certificate of official dealership (if you’re an official/exclusive dealer of a certain manufacturer).
4. Late submission will be considered as non-responsive application. Failure to furnish all information required or to submit a tender not substantially responsive to the tender documents in every respect will be at the tenderers risk and any result in the rejection of its tender.
5. In this tender process, KGN may have access to and receive from the tenderers nonpublic business information, regarding its business, sales, operation, and/or former or current customers. KGN agree to maintain the confidentiality of such information and shall not use, disclose, furnish or make accessible such information to anyone other than authorized employees and agents as necessary to carry out the tender evaluation.
Eligible Tenderers
6. This tender is open to ALL tenderers, EXCEPT:
a) Lineal families and close relatives, beneficial owners, shareholders, members of governance, and key stakeholders of KGN; and
b) Tenderers previously involved in corrupt or fraudulent practices, holding criminal records;
7. Tenderers shall declare conflicts of interests that the tenderer is not associated, or have been associated in the past, directly or indirectly, with a firm or any of its affiliates which have been engaged by KGN to advise on the preparation of the design, specifications, and other documents to be used for this tender notice.
8. If a tenderer is a joint venture, a joint venture agreement shall be submitted. The agreement must stipulate:
a) The way participants of the joint venture will share the profit or less;
b) The duties of each participant towards the joint venture;
c) The reason the joint venture has been established;
d) The start and end date of the joint venture;
e) The persons who will be the representatives of the joint venture; and
f) Conflict resolution measure (i.e., mediation or arbitration).
Cost of Tendering
9. Tenderers shall bear all costs associated with the preparation and submission of its tender. KGN in no case be responsible or liable for those costs, regardless of the conduct or outcome of the tendering process.
Clarification of Tender Documents
10. Tenderers can make inquiries on tender documents to gn.kenya.procurement@gmail.com. KGN will respond to the inquiry if received no later than three (3) days prior to the deadline for tender submission.
