Terms of Reference for Consultancy to Review and Analyze Data on Covid-19 Expenditure

1. Background and Introduction
Transparency International Kenya (TI-Kenya) is a not-for-profit organization founded in 1999 in Kenya with the aim of developing a transparent and corruption-free society through good governance and social justice initiatives. TI-Kenya is one of the autonomous chapters of the global Transparency International movement that are all bound by a common vision of a corruption-free world. TI-Kenya’s vision is “A corruption-free Kenya”. The mission is to champion the fight against corruption by promoting integrity, transparency and accountability. TI-Kenya’s work is currently organized around four strategic focus areas namely, Public Accountability; Policy, Legal and Institutional Frameworks; Social Justice and Economic Accountability, and Institutional Development.

The Covid-19 pandemic is a significant global challenge that has led to loss of lives, significant strain to health systems, loss of livelihoods and disruption of economies. To mitigate and manage the pandemic in a naturally fast manner, transparent, and accountable procurement takes even more crucial role in an emergency of this magnitude. While slow and ineffective decision-making costs lives, acceleration of procurement processes significantly increases the risks of corruption and mismanagement. Unclear emergency-related regulations, limited scrutiny, increased discretion, further contribute to these challenges. Amid a crisis, key principles in public procurement such as efficiency, effectiveness, transparency, and impartiality do not lose their critical importance. Rather they need to be reinforced and adjusted due to the needs and demands raised during these extraordinary times.

To achieve its mission and vision, Transparency International Kenya is implementing a project focusing on improving Covid-19 procurement to increase equitable access to medicines and medical equipment. Ultimately, the project seeks to strengthen emergency procurement, coordination, and supply chain management to respond to future crises.

Therefore, TI-Kenya is inviting proposals from highly motivated consultant(s) to collate and analyze available data on Covid-19 expenditure for the FY 2019/2020 and 2020/2021 from the Office of the Auditor General, Controller of Budget as well as reported data on infections and infection rates from Ministry of Health during different waves between March 2020 and March 2021.

2. Scope of Consultancy
The key goal of the research is to provide an overview of specific financial decisions made by the government in the management of Covid-19 pandemic. The consultancy, therefore, intends to produce a research report that:
• Provides an analysis of health products and technologies (HPTs) procured by National and county governments during the FYs 2019/2020 and 2020/2021 to respond to the unfolding pandemic vis a vis infection rates during the months of April 2020, November 2020, and March 2021 or the first, second and third waves of the pandemic in Kenya.
• Provides an analysis of other expenditure undertaken in the management of the pandemic in comparison to expenditure on HPTs.
• Thematically collate the audit queries from Office of the Auditor General Special Audit report on the Utilization of Covid-19 funds by County Governments and the Special Audit report on the Utilization of Covid-19 funds by KEMSA.

3. Contract Duration
The Duration of the assignment is thirty (30) working days.

4. Qualifications or specialized knowledge/experience required
Interested individual(s) should possess the following minimum qualifications:
• At least a bachelor’s degree in Statistics, Mathematics, Public Policy or any other relevant degree in Social Sciences.
• At least 5 years proven experience in conducting research and analysis on public finance management / public procurement matters.
• Proven experience in analyzing qualitative data.
• Ability to establish priorities, and to plan, coordinate and monitor own work.
• Good inter-personal skills, ability to work in a consultative and collaborative manner.

5. Application Process

6. Submission of Bids

7. Complaints Process
This call for Expression of Interest does not constitute a solicitation and TI-Kenya reserves the right to change or cancel the requirement at any time during the EOI process. TI-Kenya also reserves the right to require compliance with additional conditions as and when issuing the final solicitation documents.
Submitting a reply to a call for EOI does not automatically guarantee receipt of the solicitation documents when issued. Invitations to bid or requests for proposals will be issued in accordance with TI-Kenya rules and procedures. Any grievances and or complaints arising from the evaluation process and final tender award can be addressed, in writing, to the Executive Director and the TI-Kenya Tender Complaints Committee.
