Tender Notice: Proposed Construction of Moringa Processing Centre in Kibwezi, ChildFund International Organization
Brief Description of the Organization
ChildFund is an international child-centered development organization. We are a member of the ChildFund Alliance; a global network of 12 organizations that assists more than 15 million children in 58 countries around the world. ChildFund Kenya works through 13 local partners (LP’s) comprised of 38 community organizations in 26 counties. The thematic areas that we focus on are Child Protection, Household Economic Strengthening, Early Childhood Development, Education, WASH (Water, Sanitation and Hygiene), Emergency Response, Health and Nutrition. Our three-fold mission is to help deprived, excluded and vulnerable children improve their lives and become adults who bring positive changes to their communities: to promote societies that value, protect, and advance the worth and rights of children: and to enrich supporters’ lives through their support of our cause.
Project Background
ChildFund Kenya invites tenders from eligible candidates for construction, supply, installation, testing, commissioning and handing over of the proposed construction Moringa processing center as a turnkey project.
Qualifications
a.) Must possess a Valid Certificate of Registration /Incorporation
b.) Must possess a Valid NCA 8 and above Certificate in building works
c.) Must possess a Valid NCA practicing License
d.) Must possess a Valid Single Business Permit
e.) Must possess a Valid VAT registration Certificate
f.) Must possess a Valid Tax Compliance Certificate
g.) Must possess a Dully filled Form of Tender
h.) Must possess a Dully filled Tender Document (Confidential Business Questionnaire & Qualification Information)
i.) CV of Key Personnel relevant to the tender
j.) Holder of degree or diploma in relevant Building/engineering field 5yrs and Above
k.) At least 2 No. Certificate holder of key personnel in relevant engineering field
l.) 2No. Trade Test/Artisan
m.) Proof of Ownership of Machinery & Equipment i.e. Transport and Construction
n.) Evidence of performing similar works in the last in the last five years for at least (3) reputable clients (copies of contract agreement or works completion certificates with their values must be attached
o.) Financial statements including audited accounts for the last three years (2018-2020), certified bank statements for the last 6 months
p.) Contractors proposed method statement and works program
General Specifications
This serves as the general overview of the works, however the BOQ and tender document provides details of how the works shall be carried out.

- Doors and windows
- Internal and external finishes
- Plumbing installation
- Electrical installation
Proposed Time Frame
The expected Project is expected to take a period of 2 months.
- The deadline for completion of all the works is 28th February 2022.
- The defect liability period shall be 6 months after satisfactory completion of the works.
Variations and Alterations
The ChildFund Kenya has the right to request the contractor to carry out all variations and alterations from the plans and specifications provided that such alterations and variations have been approved.
The Contractor shall price such variations and alterations within a reasonable amount of time of the receipt of the requests by the ChildFund Kenya to do so. Work shall not be carried out on the alterations and variations until ChildFund Kenya and the Contractor have agreed to the prices charged by the Contractor for such work.
The Contractor shall state whether the alterations or variations requested will lead to an extension of time for the completion of the Works and he/she shall give the Owner his/her best estimate of the extra time required.
Extension of Time
As soon as the Contractor recognizes that the work will not be finished in the time agreed upon, he/she shall inform ChildFund Kenya of the need for more time to complete the Works and the reason for the request for the increased time.
It is the duty of ChildFund Kenya to consider the request for an extension of the contract time taking into account the reasons given by the Contractor for such extension, and to grant the request if considered reasonable in the circumstances of the construction of the Works.
Maintenance Period
The Contractor is expected to make right any defects found in the Works for a period of up to six months after the completion of the Works. If the contractor upon receipt of notification of such defects do not rectify the defects within 14 days.
ChildFund Kenya shall rectify such defects and recoup the cost from the retention.
Relations between the Builder and the Owner
The Contractor shall carry out the Works in accordance with the drawings and specifications and in accordance with any reasonable instructions by ChildFund Kenya or her representative.
As soon as possible after the signing of the contract between the ChildFund Kenya and the Contractor, the ChildFund Kenya shall inform the Contractor the name of his/her authorized representative who will represent ChildFund Kenya for the construction of the Works.
As soon as possible after the signing of the contract the Contractor shall inform ChildFund Kenya in writing the name of the person who shall be authorized by the Contractor to represent the Contractor for the construction of the Works.
ChildFund Kenya and the Contractor shall inform each other in writing when there is a change of the persons authorized to represent them for the construction of the Works.
All instructions from ChildFund Kenya or his/her representative shall be given to the Contractor or his/her representative in writing.
Accommodation
The contractor will make all the necessary arrangements for accommodation and food for the project team. Foodstuffs and other consumables (Fuels and Lubricants) will have to be transported to site at the contractor’s own expense.
Field Expenses
ChildFund Kenya will not be held responsible for any expenses incurred by the contractor or its agents during the executions of this ToR.
Payment Terms
The Payment terms will be as follows
All payments shall be made upon submission of final certificate of completion.
- Payment Certificate 90%
- 10% for retention shall be deducted on all payments made. Retention money 10% will be paid upon the expiry of the defects liability period.
- The Contractor shall be subject to VAT of 16% and 3% with-holding tax which will be deducted from total sum and be remitted to Kenya Revenue Authority Insurance
- All insurance for health care, accidents of the employees at site will be the sole responsibility of the contractor REPORT COMPILATION
- A detailed installation report shall be compiled and submitted in a bound report in 2 hard copies to ChildFund Kenya, before final payment is made to the CONTRACTOR.
- OTHER TERMS
- The contractor shall carry out the works in accordance with the Bills of Quantities provided, tendered and accepted.
- The contractor shall be at liberty to employ and engage such personnel, as the contractor shall deem fit for the purposes of execution, supervision and evaluation of the works hence ChildFund Kenya will not be held responsible for any issues affecting the workers.
Should the contractor fail, refuse and or neglect to finish the work herein contracted or any phase or part thereof or should the contractor fail to complete the job or any part thereof within the period herein punctually
agreed, then the ChildFund shall be entitled to rescind this contract and the contractor shall not be entitled for payment for uncompleted work, phase or part thereof.
The contractor shall execute the works in accordance with the relevant Laws of Kenya as they apply in all aspects of the operation including workmanship, quality of the equipment and materials.
How to Apply
All tenderers shall return tender and all accompanying documents duly completed and enclosed in a sealed envelope marked: “TENDER FOR THE PROPOSED CONSTRUCTION MORINGA PROCESSING CENTRE. The tender must be received not later than the time, date and at the address and the day stated in the invitation to tender. Tenders received later than the date specified above shall not be considered.
All items of additional information, issued to tenderers prior to the time for closing the bids, shall become a part of the Contract Documents and shall be included in the proposals. The tenderer shall, where applicable, provide leaflets and catalogues giving technical and physical details of the fittings being offered by him as an integral part of his bid. The tender documents can be collected at ChildFund offices next to Radisson Park Inn, off Waiyaki Way Westlands, Nairobi Kenya.
The Completed tender documents shall be SIGNED, SCANNED AND EMAILED TO KenyaProcurement@ChildFund.org on or before 2nd February 2022.
